It looks like the shirts worked!  That and the fact that Ma-dukes put up her house on a $500,000 bond.

Thanks to the 2nd video obtained of the shooting in the green room at Irving Plaza and some ballistic testing, 30 year old Roland Collins aka Troy Ave will not be facing murder charges.  However, he was indicted on five felonies: one count of attempted second degree murder and four counts of criminal possession of a weapon.

Although he is probably relieved to be out of prison, dropping the soap was the least of his worries. He will be fighting a huge uphill battle for at least the next year that will ultimately end in time in prison.  The only questions is just how much time.

The 2nd degree murder charge is going to be a hard one to fight based on the video evidence and the definition of 2nd degree murder.  The following three instances are classified as 2nd degree murder.

  • A killing done impulsively without premeditation, but with malice aforethought
  • A killing that results from an act intended to cause serious bodily harm
  • A killing that results from an act that demonstrates the perpetrators depraved indifference to human life

Just in case you need a reminder here is the video again.  Based on this video, Troy is lucky that he didn’t kill anyone.  It does show a shocking indifference to human life, even to a wanna be bad-ass like myself.  In addition, he will not get out of the weapon possession charges as he is holding the gun, unless he can prove that he is holding someone’s hand that is holding the gun.

NO SNITCHING

At least for now, while Troy still feels like he has a case, he is not snitching.  Assistant District Attorney Joshua Steinglass says that this is making things very difficult,

What is clear is that the investigation from the outset has been hampered by the defendant who not only fired and removed the weapon from the crime scene, he refused to help in any way (to identify) who killed McPhatter

This might change as the DA strengthens their case.  Let me explain how this works….your lawyer already knows you don’t have a case, but tries to act like you do.  This allows him to bill you more hours until one day he “suddenly” realizes that you can’t win.  Then he starts to negotiate a plea deal for a lessor sentence.  He could just start off that way, but emotionally you want to believe you have a chance and in some cases even if a lawyer told you that you didn’t, you wouldn’t believe him and your lawyer would be finished your case in half the time.  This means he would have to work twice as hard for that down payment on his boat.

That’s just what he did.  This video shows him doing the walk of no shame as two of his friends help him leave the facility.  Don’t forget, he was also shot in the leg during this entire incident.
